The Supreme Court clarified that the Election Commission of India (ECI) has no constitutional authority to decide a person's citizenship. A three-judge bench, led by Chief Justice Surya Kant, ruled that the ECI's role is strictly limited to maintaining and revising electoral rolls.
The apex court emphasized that deleting a person's name from the voter list during revision exercises does not equate to an automatic loss of Indian citizenship. The bench noted that final citizenship adjudication remains the exclusive domain of the Central Government under the Citizenship Act.
The ruling came during a hearing concerning millions of pending appeals by voters excluded from electoral rolls, with the court warning authorities against using voter deletions to strip individuals of essential state welfare benefits.
